Information We Collect

From Business Clients: Business name, contact information (name, email, phone number), business verification documents, billing and payment information, WABA credentials and API keys, business display name and profile information, message templates and content, employee and team member details who access our platform.

From End-Users (on behalf of Business Clients): WhatsApp phone numbers, message content and metadata (timestamps, delivery status, read receipts), conversation history and interaction data, order and booking information shared via WhatsApp, customer preferences and consent records, device and technical information (device type, operating system, IP address), location data when shared voluntarily in messages.

Automatically Collected Data: WhatsApp message delivery metrics and analytics, conversation volume and response times, Template performance and approval status, system logs and error reports, usage patterns and feature utilization.

How We Collect Information

We collect information through: (a) Direct submission when clients register for our services; (b) WhatsApp Business API integration and message transmission; (c) Embedded sign-up flows and onboarding processes; (d) Chatbot interactions and automated conversations; (e) Booking, order, and receipt processing systems; (f) Template creation and management interfaces; (g) Analytics and monitoring tools; (h) Customer support interactions.

Data Processing

Uniqualify processes personal data for the following purposes: (a) Transmitting and delivering WhatsApp messages on behalf of business clients; (b) Managing WhatsApp Business API accounts, credentials, and configurations; (c) Creating, submitting, and managing message templates through Meta's approval process; (d) Processing chatbot conversations, automated responses, and customer interactions; (e) Handling booking requests, order processing, and receipt delivery via WhatsApp; (f) Generating analytics, performance reports, and business insights; (g) Storing conversation history, message metadata, and interaction data; (h) Managing user consent records, opt-in/opt-out preferences, and compliance verification; (i) Processing billing, payments, and financial transactions; (j) Providing customer support and technical assistance; (k) Ensuring compliance with WhatsApp policies, POPIA, GDPR, and other applicable regulations; (l) Detecting and preventing fraud, abuse, and security threats. Legal Basis for Processing

Data Sharing with Meta (WhatsApp)

As a WhatsApp Business Solution Provider, we share data with Meta Platforms, Inc. for: (a) Message transmission through WhatsApp infrastructure; (b) Business verification and account approval; (c) Template submission and content review; (d) Compliance monitoring and policy enforcement; (e) Platform functionality and service delivery. Meta processes this data according to their WhatsApp Business Data Processing Terms and WhatsApp Privacy Policy. End-to-end encryption applies to message content between sender and recipient.

Data Sharing with Third Parties

We share personal data with: (a) Business Clients - End-user data necessary for providing their requested services; (b) Cloud Service Providers - For secure data storage and infrastructure (AWS, Google Cloud, Azure); (c) Payment Processors - For billing and payment processing; (d) Analytics Providers - For service performance monitoring and improvement; (e) Legal and Regulatory Authorities - When required by law or to protect rights and safety.

We do NOT sell or rent personal data to third parties for marketing purposes.

International Data Transfers

Your data may be transferred to and processed in countries outside South Africa, including: (a) United States - where Meta's WhatsApp servers are located; (b) European Union - where cloud infrastructure may be hosted; (c) Other jurisdictions - as necessary for service delivery.

These transfers comply with POPIA Chapter 9 requirements and are protected by appropriate safeguards including Standard Contractual Clauses, adequacy decisions, and binding corporate rules.

Data Retention

We retain personal data for: (a) Active Business Client Data - Duration of service agreement plus 7 years for legal compliance; (b) Message Content and Metadata - Up to 90 days for operational purposes, unless longer retention is required by business client or law; (c) Conversation Analytics - Aggregated and anonymized data retained indefinitely; (d) Billing Records - 7 years as required by South African tax law; (e) Consent Records - Duration of consent plus 3 years for compliance verification.

Data is deleted or anonymized when no longer necessary for stated purposes.

Data Security

We implement comprehensive security measures including: (a) End-to-end encryption for WhatsApp message content; (b) Encryption at rest and in transit for data in our systems; (c) Access controls and authentication mechanisms; (d) Regular security audits and penetration testing; (e) Employee confidentiality obligations and security training; (f) Incident response and breach notification procedures; (g) Secure API key and credential management; (h) Network security and firewall protection.

Despite these measures, no system is completely secure. We cannot guarantee absolute security but commit to promptly notifying affected parties of any data breaches as required by POPIA.

If you receive WhatsApp messages through our platform on behalf of a business: (a) You can opt-out by replying "STOP" or using opt-out mechanisms provided; (b) The business must honor your opt-out request immediately; (c) You can block the business number directly in WhatsApp; (d) You can report violations to us at [email protected] or to WhatsApp directly; (e) Your consent records are maintained and accessible upon request.

Business Client Responsibilities

Our business clients are data controllers responsible for: (a) Obtaining proper consent from end-users before messaging; (b) Providing clear privacy notices to their customers; (c) Honoring data subject rights requests from their customers; (d) Ensuring message content complies with applicable laws; (e) Maintaining their own privacy policies and practices.

Uniqualify acts as a data processor when handling end-user data on behalf of business clients.

WhatsApp Business API and Meta Integration

Our WhatsApp services are provided via Meta's WhatsApp Business Platform. When using WhatsApp messaging: (a) Messages are encrypted end-to-end between sender and recipient; (b) Meta processes metadata (phone numbers, timestamps, delivery status); (c) Meta's WhatsApp Privacy Policy applies to their data processing; (d) You interact directly with WhatsApp infrastructure; (e) Meta may use data for anti-abuse, spam prevention, and service improvement.
